Introduction

TopGigs is a product owned and operated by MYSLF Inc. ("we", "us", "TopGigs", or the "Company"), whose contact details are set out in the Contact Information section below. This Privacy Notice explains what personal data we collect, how we use and disclose it, and what rights you have, when you visit and/or use our website https://topgigs.net and the services available through it (the "Services").

For the purposes of this Privacy Notice, MYSLF Inc. acts as the data controller of your personal data processed in connection with the Services.

"Personal data" (or "personal information") means any information relating to an identified or identifiable natural person, such as a name, email address, online identifiers, or other characteristics specific to that individual (see Article 4(1) of the GDPR).

BY USING THE SERVICES, YOU CONFIRM THAT: (I) YOU HAVE READ AND UNDERSTOOD THIS PRIVACY NOTICE, AND (II) YOU ARE AT LEAST 18 YEARS OF AGE.

If you do not agree with this Privacy Notice or cannot make this confirmation, you must not use the Services. In such case, you may contact us to request deletion of your data and cancel any subscriptions using the functionality provided on the Services.

1. Personal Information We Collect

The personal information we collect depends on how you interact with the Services. Generally, we collect the following categories:

Account and contact details: name, email address, password, country/location, and other information you provide during registration and onboarding.

Quiz and profile information: your answers to our onboarding quiz and profile questions, including information about your skills, work experience, education, languages, job preferences, availability, income expectations, and career goals.

Resume data (optional): if you choose to upload a resume, we process its contents, which may include your employment history, education, skills, contact details, and other information you have included in it.

Learning and activity data: trainings you take, skill checks you pass, certificates you earn, roles you view or save, and your interactions with your matches.

AI Coach interactions: questions and other input you submit to the AI Career Coach and the responses generated.

Payment information: when you purchase a subscription, payments are processed by our third-party payment providers (such as Stripe or PayPal). We do not store your full card details; we receive limited information such as payment status, the last digits of your card, transaction identifiers, and billing history.

Usage and device information (collected automatically): IP address, approximate location derived from IP, device type and model, operating system, browser type, language settings, time zone, pages viewed, session duration, clicks and other in-service events, referral source, and campaign data (such as the advertising campaign or traffic source that led you to the Services).

Performance data: information about errors and failures that helps us diagnose problems and improve the Services.

Communications: information you provide when you contact our support team or respond to our surveys.

We collect personal information (a) directly from you, when you register, complete the quiz, upload content, or contact us; and (b) automatically, through cookies, web logs, and similar technologies. For more information about cookies, please see our Cookie Policy.

2. How We Use Your Personal Data

Depending on how you interact with the Services, we process your personal data for the following purposes:

  • Providing the Services, including generating your job matches and match scores, operating Skill Hub, issuing certificates, providing resume suggestions, and operating the AI Career Coach. Legal bases: performance of a contract; your consent.
  • Setting up and administering your account. Legal bases: performance of a contract.
  • Managing subscriptions, billing, and payments, including sending transactional emails such as purchase confirmations, renewal reminders, and receipts. Legal bases: performance of a contract; compliance with legal obligations.
  • Providing customer support and responding to your inquiries and complaints. Legal bases: performance of a contract; legitimate interests.
  • Improving the Services and developing new features, including internal research, testing, analytics, and statistics. Legal bases: legitimate interests; your consent where required.
  • Sending marketing communications about our products, such as special offers, where we have your consent or another legal basis. You can unsubscribe at any time by following the instructions in the footer of our marketing emails. Legal bases: consent; legitimate interests.

3. AI Processing

Core features of the Services are powered by artificial intelligence, including technology from external AI service providers. In particular, your quiz answers, profile information, resume data (if uploaded), and AI Coach input may be processed by AI systems to generate your matches, match scores, resume suggestions, and coach responses. Our AI service providers process this data on our behalf, under contractual restrictions, to provide the relevant functionality. We do not permit our AI providers to use your personal data to train their general-purpose models unless we tell you otherwise and have a legal basis to do so.

4. With Whom We Share Your Personal Data

Service providers. We share personal data with selected third parties who perform services on our behalf, including hosting and data storage, payment processing, AI processing, analytics, email delivery, customer support tools, security and fraud prevention, and legal and advisory services. Service providers may process your data only as necessary to provide their services to us.

Affiliates. We may share your information with entities that we control or that control us, consistent with this Privacy Notice.

Advertising and analytics partners. To analyze use of the Services and serve or measure ads, we may use solutions developed by companies such as Google and Meta. As a result, some data (such as identifiers, device data, and event data) is processed on the servers of such third parties.

Legal process and investigations. We may disclose your information in response to subpoenas, court orders, or other legal processes; to establish or exercise our legal rights; to defend against legal claims; or when we believe in good faith that disclosure is appropriate to investigate or prevent illegal activities, suspected fraud, threats to any person's safety, or violations of our Terms of Service, and to protect the rights and property of the Company, our employees, users, and the public.

Business transfers. As we develop our business, we may buy or sell assets or business offerings. If the ownership of all or substantially all of our business changes, we may transfer your information to the new owner so that the Services can continue to operate; your information would remain subject to the commitments in this Privacy Notice until it is updated or amended by the acquiring party upon notice to you.

De-identified and aggregated information. We may use and share information that has been de-identified or aggregated so that it no longer identifies you.

With your consent. We may disclose your information to other third parties with your prior consent.

We do not sell your personal information for money, and we do not share the contents of your resume or quiz answers with employers or other users. Applying to any job listing happens on the employer's or source platform's own website, and any information you provide there is governed by their privacy policies.

5. International Data Transfers

We are based in the United States, and your personal data will be processed in the United States and other jurisdictions where we or our service providers operate. Where we transfer personal data of individuals in the EU/EEA, UK, or Switzerland to countries that have not received an adequacy decision, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses and, where applicable, our service providers' certification under the EU-U.S. Data Privacy Framework. By using the Services, you acknowledge that your personal data will be transferred to and processed in the United States as described in this Privacy Notice.

6. Data Retention

We retain personal data only as long as necessary to fulfill the purposes for which it was collected, including providing the Services to you, which generally means for as long as you have an account. If you delete your account, we delete or anonymize your personal data, except where retention is required for compliance with legal obligations (such as tax and accounting requirements), dispute resolution, fraud prevention, or the establishment, exercise, or defense of legal claims — in which case the relevant data is kept for as long as required by applicable law or the applicable limitation periods.

To determine retention periods, we consider the purposes of processing, the volume, nature, and sensitivity of the data, the potential risk of harm from unauthorized use or disclosure, and applicable legal requirements. We may anonymize data for research or statistical purposes, in which case we may use it indefinitely, as it no longer identifies you.

7. Data Security

We have implemented technical and organizational measures designed to protect personal data from unauthorized or unlawful processing and from loss, destruction, or damage, and we regularly review these measures. We follow the principle of data minimization, and access to personal data is limited to employees and contractors who need it to perform their functions.

However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security. If we learn of a security breach affecting your personal data, we will notify you where we are required to do so under applicable law.

8. Your Rights

8.1 Individuals in the EU/EEA, UK, and Switzerland

You may have the following rights under applicable data protection law, including the GDPR:

  • Right of access — to obtain confirmation of whether we process your personal data and information about the purposes, categories, recipients, sources, and retention of that data, and a copy of it.
  • Right to rectification — to correct inaccurate personal data we hold about you.
  • Right to erasure — to have your personal data deleted where it is no longer necessary for the purposes for which it was collected, subject to legal retention requirements.
  • Right to restriction of processing — in certain circumstances, for example where the data is inaccurate or unlawfully processed.
  • Right to data portability — in certain circumstances, to receive your personal data in a structured, commonly used, machine-readable format and to have it transmitted to another service.
  • Right to object — to processing based on legitimate interests, and at any time to processing for direct marketing purposes.
  • Right to withdraw consent — at any time, where processing is based on consent, without affecting the lawfulness of processing before withdrawal.
  • Right to lodge a complaint — with your data protection supervisory authority.

8.2 U.S. residents

Depending on your state of residence, you may have rights under applicable state privacy laws (such as the California Consumer Privacy Act as amended), including:

  • the right to know what personal information we collect about you, and how it is used and shared;
  • the right to access and receive a copy of your personal information;
  • the right to correct inaccurate personal information;
  • the right to delete personal information collected from you (with certain exceptions);
  • the right to opt out of the "sale" of personal information or its "sharing" for cross-context behavioral advertising, where applicable;
  • the right to non-discrimination for exercising your privacy rights.

We do not sell personal information for money. To the extent that the use of advertising cookies and similar technologies constitutes "sharing" or a "sale" under applicable state law, you can opt out via our cookie settings and via the "Do Not Sell or Share My Personal Information" link on the Website, and we honor opt-out preference signals such as the Global Privacy Control (GPC) where required by law.

8.3 Response times

We process requests as quickly as possible; a complete and lawful response regarding personal data can take up to a month or, in complex cases, longer. If we need more time, we will let you know.

9. How to Opt Out of Personalized Advertising

You can limit personalized advertising through your cookie settings on the Website and through your device and browser settings:

  • Android: open Settings > Google > Ads and delete or reset your advertising ID.
  • iOS/macOS: go to Settings > Privacy & Security > Tracking / Apple Advertising and disable personalized ads.
  • Windows: Settings > Privacy > and turn off "Let apps use advertising ID".
  • Browsers: most browsers allow you to block or delete cookies; see our Cookie Policy for details.

10. Cookies

We use cookies and similar technologies as described in our Cookie Policy, available on the Website. Where required by law, we ask for your consent before setting non-essential cookies.

11. Children's Personal Information

The Services are not directed at children, and we do not knowingly process personal data of persons under 18 years of age. If we learn that any information we have collected was provided by a person under 18, we will promptly delete it. 12. How You Can Access and Update Your Information

You can access, review, and update certain profile information by logging into the Services and editing your account, or by contacting us at [email protected]. You can delete your account in your account settings or by contacting us. Please note that deleting your account does not by itself cancel an active subscription — see our Subscription Terms.

13. Changes to This Privacy Notice

We may update this Privacy Notice from time to time. If we make material changes to how we collect, process, or use your personal data, we will notify active users in accordance with our Terms of Service (for example, by email or a prominent notice on the Services). The updated Privacy Notice is effective upon posting on the Website.
